Terms and Conditions

These terms govern the use of the sites and services operated by Sinapsis SpA ("Sinapsis", "we"): sinapsis.in, the HumanOS platform (humanos.eco, empresa.eco, estudiante.humanos.eco) and the QueBot assistant, including its WhatsApp channel (together, the "Services"). By accessing or using the Services you accept these terms; if you do not agree, do not use them.

1. About Sinapsis

Sinapsis SpA, Chilean Tax ID (RUT) 78.327.684-4, is a Chilean consulting, technology and innovation firm, domiciled at San Martín 924, Office 213, Temuco, Chile. Contact: admin@sinapsis.in.

2. Description of the Services

• Corporate site (sinapsis.in): company information and contact channels.
• HumanOS: a platform integrating personal and family life, health, finance, agenda, business, students, reports, AI assistants and automations, in separate views per domain (personal, business, student).
• QueBot: a specialized conversational and document assistant based on AI, available inside HumanOS and via WhatsApp.
• Professional services: consulting, implementation and custom development, governed by the specific proposals and agreements signed with each client, which prevail over these terms where applicable.

AI assistants provide guidance and reference information; they do not replace advice from a licensed professional (lawyer, accountant, physician, auditor or other). For specific situations, always consult a professional.

3. Registration and account

• Some Services require an account, authenticated through Google OAuth 2.0. We do not store or have access to your Google password.
• You are responsible for the security of your credentials and for activity performed with them.
• You must provide truthful information and keep it up to date.
• Use of the Student module by minors requires the consent of the responsible adult, as described in Annex C of the Privacy Policy.

4. Acceptable use

When using the Services you agree to:

• Not use them for illegal, fraudulent, abusive or discriminatory activities.
• Not attempt to access other users' or organizations' data or breach system security.
• Not interfere with the operation of the Services or artificially overload them.
• Not reverse engineer the software, except as mandatorily permitted by law.
• Respect the intellectual property rights of Sinapsis and third parties.

We may suspend accounts that violate these rules (section 11).

5. Ownership of your data

The personal, family, business and other data you enter into the Services remain your exclusive property (or your organization's, as applicable). Sinapsis claims no ownership over your data: you grant us a limited, non-exclusive, revocable license to process it for the sole purpose of providing and improving the Service, in accordance with the Privacy Policy. You may export your data and request its deletion at any time.

6. Intellectual property

The software, design, code, trademarks, logos and content of the Services are the property of Sinapsis SpA or its licensors and are protected by intellectual property law. No license over these elements is granted to you beyond the use necessary to access the Services. Responses generated by the assistants are provided for your personal or professional use.

7. Use of artificial intelligence

By using the AI assistants (QueBot and HumanOS AI features) you acknowledge and accept that:

• AI-generated responses may contain errors, omissions or outdated information; we do not guarantee their accuracy, completeness or currency.
• Generated content does not constitute legal, financial, medical or other professional advice.
• It is your responsibility to verify information before acting on it.
• Your queries may be processed by AI providers (Anthropic) as described in the Privacy Policy — with prior scrubbing of identifiers and no use for model training.
• AI use is further governed by the Responsible AI Policy.

8. Google integrations

If you authorize integrations with Google services (OAuth, Calendar):

• We will only access the data you explicitly authorize.
• You can revoke access at any time from your Google account settings.
• Our use of Google data adheres to the Google API Services User Data Policy, including the Limited Use requirements.

9. Privacy and data

Personal data processing is governed by our Privacy Policy (a single policy for all Services, with per-service annexes) and the complementary documents: Cookies, Information Security and Responsible AI.

10. Availability and limitation of liability

• The Services are provided "as is" and "as available", without express or implied warranties, including uninterrupted availability or a minimum SLA.
• Interruptions may occur due to maintenance, updates, force majeure or dependence on third parties (Google, Anthropic, cloud providers).
• We may modify or discontinue features, endeavoring to give reasonable prior notice of substantial changes.
• To the maximum extent permitted by law: we are not liable for indirect, incidental, special, consequential or punitive damages, nor for decisions made relying solely on AI responses without human verification; and our total liability is limited to the amount paid for the Services in the 12 months preceding the event giving rise to the claim.
• Nothing in these terms limits non-waivable rights you may have as a consumer under Chilean law.

11. Termination

• You may stop using the Services at any time and request deletion of your account and associated data (see timelines in the Privacy Policy).
• We may suspend or close accounts that violate these terms, notifying you of the cause unless legally prevented.

12. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Chile. Any dispute shall be submitted to the ordinary courts of Temuco, Chile, without prejudice to consumers' non-waivable rights and any venue rules in their favor.

13. Modifications

We may modify these terms by publishing the updated version on this page, with a new date and version number (verifiable versioning with SHA-256 fingerprints, as with the Privacy Policy). For substantial changes we will communicate through the platform or by email. Continued use of the Services after publication constitutes acceptance.

14. General provisions

• If any clause is declared invalid, the remainder stays in full force.
• Failure to exercise a right does not constitute a waiver of it.
• These terms, together with the Privacy Policy and the documents they reference, constitute the entire agreement between you and Sinapsis regarding the Services.
